Public offer

1. General provisions

This document is a public offer (an offer to conclude an agreement) by the FotoPas service (hereinafter — the “Provider”) in accordance with Article 407 of the Civil Code of the Republic of Belarus.

Acceptance (full and unconditional acceptance of the offer terms) is considered to be placing an order and paying for the service. From the moment of acceptance, a service agreement is concluded between the Provider and the Customer.

By placing an order, the Customer confirms that they have read the terms of this offer, including the warning that the photo is created using artificial intelligence (Section 2 of this offer), and accept them in full.

2. Photos are generated by artificial intelligence

All photos created by the FotoPas service are generated using artificial intelligence technologies. Processing is performed automatically: the service applies many image recognition and processing technologies (face detection, composition control, cropping, background, lighting and size correction).

We cannot guarantee a one hundred percent match of the result with the original photo or with your expectations. The decision on whether to use the generated photo for a document is made solely by you. We cannot foresee whether questions may arise about the photo during checks at the border, in consulates or authorized bodies of different countries, including in connection with the use of artificial intelligence technologies.

3. Subject of the offer

The Provider undertakes to prepare a document photo from the selfie uploaded by the Customer: cropping, face alignment, background, lighting and size correction in accordance with the requirements for the chosen document type.

The result of the service is:

• a photo file without a watermark in JPG format (for printing and electronic use);
• a PDF file with copies for printing on one sheet (for the Belarus passport — 4 copies of 40×50 mm with a cut line).

Photo preparation is performed automatically using artificial intelligence technologies.

The artificial intelligence technologies used by the Provider work on the basis of the image uploaded by the Customer. The result may differ from the original shot: changes in pose, facial expression, lighting, background and other elements of the image are possible. The Provider does not guarantee a full (100%) match of the result with the original photo or with the Customer's expectations.

The created photo is the result of automatic processing and is not an official document. The admissibility of its use for specific purposes (submission for a document, visa, border crossing, etc.) is determined by the requirements of authorized bodies and the rules of a particular country and cannot be guaranteed in advance by the Provider.

4. Cost and payment procedure

The cost of the service is 5⚡ for processing one order. The price is indicated on the website and confirmed when ordering. Payment is one-time for each service.

The cost includes: processing of one selfie, a JPG file without a watermark and a PDF with copies for printing. Each additional photo (a new order) is paid separately.

The service is considered rendered from the moment the finished file appears in the Customer's personal account or on the order page.

5. Refunds

A refund is made in cases of: double charge, payment without providing a finished file, a damaged or unavailable file, a confirmed technical error.

Priority order: first, the Provider corrects the result or performs repeated processing for free; if this is impossible, the full cost of the service is refunded.

To get a refund, contact support ([email protected]), stating the order number, date and amount. Review takes up to 5 business days; the refund is made in the same way as the payment.

6. Liability of the parties

The Customer is responsible for the correctness of the uploaded image (quality, clarity, suitability of the source shot) and for choosing the document type.

The Customer confirms that they have been informed about the nature of the service: the photo is created using artificial intelligence technologies (see the warning at the beginning of the offer). The decision on whether to use the generated photo for submission to authorized bodies, consulates, at the border or for other purposes, the Customer makes independently and voluntarily, realizing that the photo was created by artificial intelligence.

The Provider applies image recognition and processing technologies and brings the photo in line with public technical requirements for the chosen document type (size, background, face proportions), however:

• does not guarantee a 100% match of the result with the original photo or the Customer's expectations;
• is not liable for the decision of an authorized body (agency, consulate, border service) to accept or refuse the photo, including because it was created using artificial intelligence or for any other reasons related to the internal rules of such a body;
• is not liable for consequences arising for the Customer in connection with the use of the generated photo (refusal to issue a visa or document, refusal of entry, administrative or other consequences).

A decision of an authorized body to refuse the photo is not an automatic ground for a refund if the photo meets the technical requirements for the given document type and the service was rendered properly.

The Provider is not liable for direct or indirect damage, lost profit or other losses of the Customer arising from the use or impossibility of using the result of the service, except for cases provided by the legislation of the Republic of Belarus.

These terms do not limit the mandatory consumer rights provided by the legislation of the Republic of Belarus. Everything not regulated by this offer is governed by the current legislation of the Republic of Belarus.

7. Data processing and storage

The uploaded photos are used exclusively for preparing the result and are not shared with third parties. Personal data processing is carried out in accordance with the Privacy policy.

Order files are automatically deleted from the Provider's servers after the retention period (24 hours after the order is created).
